When becoming new for a landowner in a forest, notification is needed.
In accordance with the amendment to the Forest Act of Japan in April 2011,
those who become forestland owners on or after 1 April 2012 are obligated
to report the ownership to the relevant municipalities.
■ Land subject to Notification System
Any forestlands subject to Hokkaido’s forest plan (according to Paragraph 1, Article 5 of the Forest Act of Japan) are also subject to the notification system. Note that the land which is not classified as, but is apparently, forestland is also likely subject to the notification system upon acquisition. Please confirm by contacting the relevant office*.
■ People subject to Notification System
Whether as an individual or a corporation, forestland acquired through transaction, inheritance, donation, corporate merger or any other means must be reported regardless of the land area. Note that notification is not necessary for forestland owners who have submitted a land trade notification (tochi baibaitou todokede sho) based on the National Land Use Planning Act of Japan.
■ Notification Period
Notification is to be made after acquisition. New forestland owners must submit the Notification of Forestland Ownership form to the relevant municipalities within 90 days from the date on which they become owners of the forestland.
■ Information required on Notification of Forestland Ownership form
The form requires applicants to report information such as: (1) the name and address of previous and new owners, (2) the date on which the new owner acquires the land, (3) the reason for ownership transfer, (4) the address and area of the land, and (5) the purpose of land ownership. In addition, applicants must attach a certificate of registered matters (a copy is possible) or a copy of the document which proves rights ownership (e.g., land trade agreement), and a drawing which shows the land’s location.
